The Independent Police Conduct Authority has found that Police officers involved in two pursuits in which teenagers lost their lives in January 2016 were justified in commencing pursuit and complied with law and Police policy throughout.

The Independent Police Conduct Authority has found that two Police officers were justified in shooting David Cerven, a Slovakian national, in Myers Park, Auckland on 2 August 2015. However, the actions of the officers, in deciding to immediately approach and challenge Mr Cerven while he was engaged with other unarmed officers, precipitated Mr Cerven’s response.

The Independent Police Conduct Authority has found that Police were justified in their initial pursuit of a BMW. However, due to the high risks involved, the Armed Offenders Squad (AOS) officer in pursuit should have abandoned the pursuit at an earlier stage, and should not have tried to forcefully stop the BMW by himself.
