The Independent PoliceConduct Authority has found that two Police officers were justified in shootingDavid Cerven, a Slovakian national, in Myers Park, Auckland on 2 August 2015.However, the actions of the officers, in deciding to immediately approach andchallenge Mr Cerven while he was engaged with other unarmed officers,precipitated Mr Cerven’s response.

The Independent Police Conduct Authority has found that Police were justified in their initial pursuit of a BMW. However, due to the high risks involved, the Armed Offenders Squad (AOS) officer in pursuit should have abandoned the pursuit at an earlier stage, and should not have tried to forcefully stop the BMW by himself.

 The Independent Police Conduct Authority released a report today finding that Police unlawfully arrested a man at his home in Upper Hutt on 23 January 2015, after mistaking him for an offender they were seeking.
