Complaint of an officer behaving unprofessionally and pointing a firearm

The Authority oversaw a Police investigation into an allegation an officer conducted themselves in an unprofessional manner and pointed a firearm without cause at a member of the public in Hikuai.

The officer was travelling to the station to start their shift when they came across the individual on the side of the road, digging out a vehicle with a shovel. The two discussed what had occurred, which lead to an argument. The officer felt threatened by the individual who swore at them and gestured with the spade, so left.

The officer shortly returned, now in uniform, but found the individual had moved into a nearby bush area. The officer armed themself, concerned about the risk if the matter escalated. The officer drew and pointed the firearm at the ground whilst walking into the bush, looking for the individual. The officer then holstered the firearm before resolving the situation without incident.

The Police investigation found there was insufficient evidence to say the officer pointed the firearm or behaved inappropriately. However, Police found the officer’s decision-making leading up to the event involved a breach of Police policy, and the officer was sanctioned.

The Authority agrees with the findings and outcome of the investigation.
