Police response to removing a formal written warning issued in Auckland City

31 January 2023

The Authority received a complaint from a man who was issued a formal written warning for assault on a police officer which he did not accept.

For Police to issue someone a formal warning, one of the requirements is for the suspect to clearly acknowledge they committed the offence and agree to the warning. If the person refuses, Police can consider laying a charge.

In this case, after completing a full review of the situation, Police agreed to remove the warning because there was no proof the man admitted to the offending at the time the warning was issued.
