The Authority oversaw a Police investigation into an allegation two off-duty Auckland officers had been fighting in a public place.
The officers had been out drinking with their colleagues for a Christmas celebration when one officer became involved in a fight with two members of the public who were at the same bar. The second officer then entered the fight in order to defend his colleague.
The fight was quickly broken up, but the first officer had been knocked unconscious during the fight and required medical intervention.
Police conducted both criminal and employment investigations into the incident. Following consideration of the criminal investigation, it was determined that prosecution was not warranted. Police then undertook employment processes, resulting in a finding of misconduct against one officer.
The Authority agrees with Police decision-making in this matter and the outcome reached.
