Alleged use of excess force by officer during arrest

The Authority oversaw a Police investigation into an allegation that a Police officer used excess force against the driver of a car which had undergone a sustained loss of traction in Northland.

The driver was being dealt with by other officers and complying with their instructions, albeit slowly, due to a pre-existing injury. The subject officer of this complaint inserted himself into the arrest process and applied force

that was neither warranted nor justified in the circumstances. Other officers raised concerns regarding the officer’s conduct, and Police investigated.

Police concluded that the force used by the officer was technically excessive but was fleeting in nature, causing no injury and eliciting no complaint from the driver. Police determined that the test for prosecution was not met,

and the matter was dealt with by way of an internal employment process.

The Authority is satisfied that an appropriate employment outcome was imposed.
