Police officer investigated for excessive force against detainee in Waikato District

The Authority oversaw a Police investigation into a complaint alleging that a Police officer assaulted a detainee while he was in Police custody.

The investigation included reviewing the custody footage, which showed the officer placed his left hand into the detainee’s throat and forced him back into the wall. The detainee was in the process of being searched prior to going into a cell and did not appear aggressive or threatening at the time.

Police found the force used by the officer was unjustified and considered there was sufficient evidence to charge the officer with assault. They instead referred the officer to the Te Pae Oranga Iwi Community Panel (TPO). The TPO meeting did not proceed due to heightened tensions between the officer and the complainant, and it was deemed inappropriate to continue in the TPO space.

After reviewing the matter, Police charged the officer with assault.

The officer pleaded guilty and was discharged without conviction. The officer was ordered to make an $1,000 emotional harm payment to the victim.

Police commenced an employment process, however the officer resigned before the matter concluded.

The Authority is satisfied with the investigation undertaken and the outcome.
