The Authority oversaw a Police investigation into a complaint that a Police officer used excessive force during an arrest of a man, incorrectly searched him, and indecently assaulted him. The complainant also alleged that the initial arrest was not justified.
The Police investigation found that the initial arrest had been justified, and that there was no evidence of an indecent assault or incorrect search. However, they found that the arresting officer did use excessive and unnecessary force while restraining the complainant.
Police conducted a criminal investigation. Although the complainant was unwilling to engage, Police considered there was sufficient evidence to charge the officer with assault. They instead referred the officer to the Te Pae Oranga Iwi Community Panel, which he successfully completed. The Authority agreed that an alternative to prosecution was appropriate in the circumstances.
The subsequent Police employment investigation found that the officer’s behaviour amounted to serious misconduct and breached the Code of Conduct.
The Authority agrees with the findings, outcome and actions taken by Police.
