Complaint of Police use of pepper spray after pursuit

The Authority oversaw a Police investigation where it was alleged a Hutt Valley officer used excessive force on a man when arresting him after a short pursuit.

The man had been stopped by the officer but drove off before the officer had finished dealing with him. The officer followed the man for about 300 metres at speeds of around 30kph before the man stopped and got out of his vehicle. During the engagement that followed, the officer sprayed the man with pepper spray.

The investigation found that although the pursuit was not dangerous the officer did not need to pursue the vehicle because he knew the man's identity and the circumstance did not warrant a pursuit.

The investigation also found that the use of pepper spray was lawful and reasonable in the circumstances, as the man was not complying with instructions, was resisting arrest and was warned that pepper spray would be used if his behaviour continued.

The breach of fleeing driver policy was addressed with the officer involved.

The Authority agrees with the Police findings and action taken to address the officer's breach of policy.
